These Terms of Service (the "Terms") govern your access to and use of the website ziamorewear.com, and any related content, features, products and services (together, the "Services") operated by Ziamore LLC, a Wyoming limited liability company ("Ziamore", "we", "us", "our"). The Services are hosted on Shopify.
By accessing or using the Services, or by placing an order, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, Return & Refund Policy and Payment Policy, which are incorporated by reference. If you do not agree, do not use the Services.
You must be at least 18 years old, or the age of majority in your place of residence, to purchase from us. By using the Services you represent that you meet this requirement and that any information you provide is accurate, current and complete. You are responsible for keeping your account credentials confidential and for all activity under your account.
We take care to display our products accurately. Colours, textures and materials may nevertheless appear differently on screen than in person. All products are subject to availability and we may discontinue or modify any product at any time without notice. We may limit quantities per order, per person or per household.
Your order is an offer to purchase. We may accept or decline it at our discretion, including where a product is unavailable, where we identify a pricing or description error, or where we suspect fraud or a breach of these Terms. A contract is formed only when we send you a shipping confirmation. If we cancel an order after payment, we will refund the full amount to your original payment method.
Prices are shown in the currency selected at checkout and may change without notice; the price charged is the price displayed when you place your order. Shipping costs and any applicable taxes are shown at checkout before you confirm. Payment terms are described in our Payment Policy. By providing a payment method you confirm that you are authorized to use it.
Delivery times are estimates and are not guaranteed. Title and risk of loss pass to you on delivery, except where applicable law provides otherwise. Full details are in our Shipping Policy.
Returns, exchanges and refunds are governed by our Return & Refund Policy. Nothing in these Terms limits any rights you have under applicable consumer protection law.
The Services and all content, including the Ziamore name and logo, product designs, photography, text, graphics and code, are owned by or licensed to Ziamore LLC and are protected by copyright, trademark and other laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify or create derivative works from any content without our prior written permission.
You agree not to use the Services for any unlawful purpose; to interfere with or disrupt the Services; to attempt unauthorized access to any system or data; to scrape, harvest or collect data without permission; to upload malicious code; or to impersonate any person or entity. We may suspend or terminate your access for any breach.
If you submit reviews, comments, images or other content, you grant Ziamore LLC a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, publish and display that content in connection with the Services and our marketing. You confirm that you own or have the rights to the content and that it does not violate any law or third-party right. We may remove content at our discretion.
The Services may include links to third-party websites, carriers, payment providers and other tools that we do not control. We are not responsible for their content, policies or practices. Your dealings with third parties are solely between you and them.
Our store is hosted by Shopify. All purchases are made with Ziamore LLC, not Shopify. Shopify is not responsible for the products we sell or for your transactions with us.
To the fullest extent permitted by law, the Services and products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, Ziamore LLC and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from or related to the Services or any product, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.
You agree to indemnify and hold harmless Ziamore LLC and its affiliates, members, managers, employees and agents from any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Before starting any formal proceeding, you agree to contact us at support@ziamorewear.com so that we can try to resolve the matter informally within 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer, you keep any mandatory protections of the law of your country or state of residence.
If any provision of these Terms is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, sale or reorganization.
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Services after changes take effect means you accept them.
